Privacy Notice for the Apprenticeship Evaluation Survey 2023

Who we are
This work is being carried out by IFF Research which is conducting this survey on behalf of the Department for Education (DfE). For the purpose of data protection legislation, the DfE is the data controller for the personal data processed as part of this project.

How we will use your information
DfE will receive a survey dataset based on your answers to the survey you complete as part of this project. These surveys are carried out on behalf of the department by IFF Research. IFF Research will also receive some personal data for apprentices from information held on the Individualised Learner Record (ILR), which is being used as the sample source for the study. Some of this data will be provided to DfE in a survey dataset. Non-identifiable data might also be shared with the Department for Business and Trade.

Your name, address, phone number and email will not be sent to DfE in combination with survey data. The exception to this is if safeguarding risks are identified during the survey. In this case, IFF Research will share your name and contact details with DfE, who will contact your apprenticeship provider to discuss the issue. If an immediate threat to harm yourself or others is identified, IFF Research will contact the emergency services.

The aim of this research is to explore whether the apprenticeships programme is meeting the needs of its end users (apprentices and employers); consistently delivering professionally recognised qualifications and skills; and delivering value for money. This will have public benefit, as it will provide the Department with the evidence it needs to make evidence-based policy decisions. Understanding the views and experiences of apprentices and employers will help the Department better support families' and children's education.

The nature of your personal data we will be using
The categories of your personal data that IFF Research will be receiving from the ILR for this project are: your full name, email address, telephone number, unique identifiers used on DfE datasets, address, gender, age, ethnic origin, the existence (but not details) of any disability, learning difficulty or special educational needs, prior employment status, prior educational attainment, and details regarding any apprenticeship learning you have taken part in since 2020.

This data will be used in order to contact you for the purposes of the research, analyse the performance of apprenticeships in terms of equalities (e.g. by ethnic origin), analyse the performance of apprenticeships for learners of different educational and employment backgrounds, and analyse the performance of different types of apprenticeship.

Why our use of your personal data is lawful
In order for our use of your personal data to be lawful, IFF Research and DfE need to meet one (or more) conditions in the data protection legislation. For the purpose of this project, the relevant conditions are:
  • Substantial Public interest based in law (Article 9(2)(g)) - processing is necessary for reasons of substantial public interest, on the basis of Union or Member State law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.
  • Public task (Article 6 (1)(e)) - the processing is necessary for the organisation to perform a task in the public interest or for the organisation’s official functions, and the task or function has a clear basis in law.
  • Legislation within Section 122 of the Apprenticeships, Skills, Children and Learning Act 2009 allows the sharing of learner data to a person providing services to the Secretary of State (i.e. DfE commissioned / contracted) to enable or facilitate the exercise of any function of the Secretary of State relating to education or training. This applies to this research since it facilitates the functions of the Secretary of State regarding the delivery of work-based training in England.

Who we will make your personal data available to
We sometimes need to use other research organisations to help us deliver large pieces of work. In such instances we have a contract with these organisations. For the purposes of this project our contracted partner IFF Research has been employed to process your personal data on our behalf.

How long we will keep your personal data
Unless you agree to be contacted for future follow-up research during the survey, all personal data used to contact you (your name, address, telephone number, email), or data stored in combination with that information, will be deleted within 12 months of the end of the research. The research is expected to conclude in January 2024. We will retain contact details of those willing to take part in further research until July 2025 to allow for future follow-up research.

With your express permission, which you may give or refuse at the end of the survey, DfE may be provided with a unique identifier to link the data to other data about you held by DfE. Otherwise, DfE will keep an anonymised version of your personal data for future analysis, as per the GDPR exemption on retaining personal data used for scientific, or historical research purposes in accordance with Article 89(1).
